TERMS OF SERVICE

1. Introduction
These Terms of Service govern access to and use of any BossFotos website, application, embedded viewer or related service (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.
BossFotos is operated by Fotoboss Pty Ltd (“BossFotos”, “we”, “us”).
2. BossFotos Role – Platform Provider and Agent
BossFotos operates a technology platform that enables photographers (“Photographers”) to host, display and sell digital photographs directly to customers (“Customers”).
Unless expressly stated otherwise in writing:
- Photographers are the sellers of photographs to Customers.
- BossFotos does not sell, resell or supply photographs to Customers.
- BossFotos acts solely as a disclosed agent and platform provider, offering hosting, distribution, payment facilitation and related technical services.
- Photographers:
- Set their own prices;
- Control how and where their photographs are marketed;
- Are responsible for promoting and selling their photographs.
BossFotos may display Photographer galleries on its Platform to provide additional exposure, but does not guarantee sales and does not market photographs on behalf of Photographers.
Photographer branding applies to galleries and sales pages. At checkout, Customers are informed that payment is collected by BossFotos on behalf of the Photographer. BossFotos may provide customer support in relation to payment processing, technical issues and use of the Platform.
3. Customer Transactions
Customers purchase photographs directly from Photographers. Any contract for sale is formed solely between the Customer and the Photographer.
BossFotos is not a party to the sale contract and is not responsible for the content, quality, legality or suitability of photographs.
4. Platform Fees and Payments
BossFotos charges Photographers platform fees for use of the Platform. Fees may be calculated as a percentage of sales or as otherwise agreed.
BossFotos may collect payments from Customers on behalf of Photographers, deduct applicable platform fees, and remit the balance to the Photographer in accordance with applicable payout schedules.
5. Accounts and Registration
Users must provide accurate and current information when creating an account and are responsible for all activity conducted through their account.
6. Intellectual Property
All intellectual property rights in photographs remain with the Photographer or their licensors. BossFotos retains all rights in its Platform, software, branding and proprietary content.
7. Acceptable Use
Users must not misuse the Platform, interfere with its operation, infringe intellectual property rights, violate applicable laws, or use the Platform for unlawful or prohibited purposes.
8. Refunds
Refunds, if any, are governed by the Photographer’s policies and applicable law. BossFotos may assist with refund processing where payment was facilitated through the Platform.
9. Photographer No-Shows
Where Photographers are booked through the Platform for events, BossFotos may reimburse direct Photographer costs in the event of a no-show but is not liable for lost sales or anticipated revenue.
10. Limitation of Liability
To the fullest extent permitted by applicable law, BossFotos is not liable for indirect, consequential or economic losses arising from use of the Platform.
11. Indemnity
Users agree to indemnify and hold harmless BossFotos against claims arising from their use of the Platform or breach of these Terms.
12. Termination
BossFotos may suspend or terminate access to the Platform at its discretion.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which BossFotos is incorporated, without regard to conflict of law principles.
14. Changes
BossFotos may update these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.
